This website is owned and operated by Ma Pamboli Ltd, a UK limited company (“Ma Pamboli”, “we”, “us” or “our”).

These Terms and Conditions apply to the use of our website and to bookings for retreats, workshops, meetings, training sessions and other events organised by Ma Pamboli.

By using our website or making a Booking, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these Terms and Conditions, please do not use our website or book our services.

1. Definitions

For clarity in this policy:

  • “Participant”means the individual named on a Booking for an Event.
  • “Event” means any Retreat, meeting, workshop, seminar, training session, talk or other in-person or online event organised by Ma Pamboli.
  • “Retreat” means a residential, multi-day retreat organised by Ma Pamboli.
  • “Non-Retreat Event” means an Event that is not a residential Retreat, including meetings, workshops, training sessions, seminars and talks.
  • “Booking” means a reservation for a place on an Event made in accordance with these Terms and Conditions. For a Retreat, a Booking is confirmed once Ma Pamboli has accepted the booking and received the required Deposit.
  • “Deposit” means the initial non-refundable payment required to secure a place on a Retreat.
  • “Retreat Fee” means the total amount payable by the Participant for their place on the Retreat, including the Deposit.
  • “Balance” means the remaining Retreat Fee payable after deduction of the Deposit and any other payments already made.
  • “Retreat start date” means the first scheduled day of the Retreat.
  • “Organiser” means Ma Pamboli Ltd.

Where these Terms refer to two and a half (2.5) months before the Retreat Start Date, this means seventy-five (75) calendar days before the Retreat Start Date.

Where these Terms refer to thirty (30) days before the Retreat Start Date, this means thirty (30) calendar days before the Retreat Start Date.

2. Retreat Bookings, Deposits and Payments

Booking Confirmation

A Retreat Booking is confirmed only once Ma Pamboli has accepted the Booking and received the required Deposit.

An enquiry, application or expression of interest does not guarantee or reserve a place unless otherwise confirmed by Ma Pamboli in writing.

Deposit

A non-refundable and non-transferable Deposit, in the amount specified at the time of booking for the relevant Retreat, is required to secure your place.

The amount of the Deposit may vary between Retreats.

Payment of the Retreat Fee

Participants may be offered the option to either pay the Retreat Fee in full or pay by instalments, depending on the payment options available for the relevant Retreat at the time of booking.

Payment in Full: Where a Participant chooses to pay the Retreat Fee in full at the time of booking, no further payment will be due in respect of the Retreat Fee.

Payment by Instalments: Where a Participant chooses to pay by instalments, the Deposit is payable at the time of booking and the remaining Balance must be paid in accordance with the agreed payment schedule. In all cases, the Retreat Fee must be paid in full no later than two and a half (2.5) months before the Retreat Start Date, unless a different final payment deadline is specified at the time of booking.

Payment of the Deposit secures the Participant’s place but does not remove their obligation to pay all remaining instalments by the applicable deadlines.

If an instalment is not received by its due date, Ma Pamboli may contact the Participant and request payment. If the outstanding payment remains unpaid, Ma Pamboli may treat the Booking as cancelled by the Participant, in which case the applicable cancellation provisions in these Terms and Conditions will apply.

Participants remain responsible for ensuring that all payments are made by the applicable deadlines, whether or not a payment reminder is received.

Currency and International Payments

Unless otherwise stated, all payments to Ma Pamboli are charged in Great British Pounds (GBP, £).

Participants paying from a bank account or card denominated in another currency understand that the final amount appearing on their bank or card statement may vary depending on the exchange rate applied by their bank, card issuer or payment provider at the time the payment is processed.

Ma Pamboli charges payments in GBP and has no control over international exchange rates, currency conversion charges or other fees imposed by banks, card issuers or payment providers.

3. Travel Arrangements and Insurance

Unless expressly stated as being included as part of an Event, Participants are responsible for arranging and paying for their own travel and transportation to and from the Event.

Where travel, transportation, transfers or excursions are included or arranged as part of an Event, the specific arrangements and inclusions will be communicated to Participants.

Ma Pamboli is not responsible for delays, cancellations, missed connections or other travel-related costs or losses arising from travel arrangements made independently by Participants, except where liability cannot lawfully be excluded.

Participants are strongly encouraged to obtain comprehensive travel insurance appropriate to the Event and their individual circumstances as soon as their Booking is confirmed.

Where a Participant’s country of residence is different from the country in which the Event is taking place, comprehensive travel insurance is mandatory.

Where applicable, insurance should include appropriate cover for cancellation, illness and medical treatment abroad, emergency assistance and repatriation, travel disruption, lost or damaged belongings, and any activities or excursions in which the Participant intends to take part.

Ma Pamboli may request evidence of appropriate travel insurance before the Event. Where travel insurance is mandatory and a Participant fails to obtain appropriate insurance or provide evidence of it when reasonably requested, Ma Pamboli may refuse the Participant’s participation in the Event. The applicable Participant cancellation terms will apply.

It is the Participant’s responsibility to ensure that their chosen insurance policy provides adequate cover for their individual circumstances and planned activities.

4. Passports, Visas and Travel Requirements

Where an Event requires travel outside the Participant’s country of residence, the Participant is responsible for ensuring that they meet all applicable travel and entry requirements.

This includes, where applicable, ensuring that they have a valid passport, appropriate visa or travel authorisation, required vaccinations or health documentation, and any other documentation required by the destination or transit country.

Participants are responsible for checking applicable requirements sufficiently in advance of travel and for any costs associated with meeting those requirements.

If a Participant is unable to attend an Event because they do not have the necessary passport, visa, travel authorisation or other required documentation, this will be treated as a Participant cancellation and the applicable cancellation terms will apply.

Ma Pamboli is not responsible for a Participant being refused entry to, or required to leave, a destination because they have failed to satisfy applicable entry or immigration requirements.

5. Accommodation and Room Allocation

Where accommodation is included in an Event, the accommodation and room or bed category included in the Participant’s Booking will be specified at the time of booking.

Ma Pamboli will make reasonable efforts to provide the accommodation category booked. In exceptional circumstances, including circumstances outside Ma Pamboli’s reasonable control, it may be necessary to change a Participant’s room, bed or accommodation allocation.

Where a change materially affects the accommodation category included in the Participant’s Booking, Ma Pamboli will make reasonable efforts to provide accommodation of an equivalent or higher standard. If only a lower-priced accommodation category can be provided, Ma Pamboli will refund the difference between the price paid for the booked category and the price applicable to the replacement category.

Participants must comply with reasonable accommodation and venue rules during their stay.

6. Participant Cancellations and Refunds – Retreats

All cancellations are subject to the following terms.

More Than 75 Days Before the Retreat Start Date

If a Participant cancels more than seventy-five (75) calendar days before the Retreat Start Date:

  • the Deposit is non-refundable and non-transferable; and
  • any additional payments made may, at Ma Pamboli’s discretion, be applied as a one-time credit towards another Ma Pamboli Retreat taking place within twelve (12) months of the originally scheduled Retreat Start Date.

Any credit is subject to availability and may not be exchanged for cash.

75 Days or Less Before the Retreat Start Date

If a Participant cancels seventy-five (75) calendar days or less before the Retreat Start Date, all payments made are non-refundable and no credit will be issued, subject to any rights the Participant may have under applicable law.

The Participant may, however, request to transfer their Booking to another eligible individual in accordance with the Transfer of a Retreat Booking provisions set out in these Terms and Conditions.

No-Shows, Late Arrivals and Early Departures

No refund or credit will normally be provided where a Participant:

  • does not attend the Retreat;
  • arrives after the Retreat has begun; or
  • chooses to leave before the Retreat has ended.

7.  Transfer of a Retreat Booking

A Participant may request to transfer their Booking to another individual up to five (5) calendar days before the Retreat Start Date.

Transfer requests must be received no later than 23:59 on the sixth calendar day before the Retreat Start Date. For example, if a Retreat begins on 10 October, the request must be received by 23:59 on 4 October.

All transfer requests must:

  • be submitted in writing to info[at]mapamboliretreats.com;
  • provide the information reasonably requested by Ma Pamboli about the proposed replacement Participant; and
  • be approved by Ma Pamboli.

Transfers are not automatic. The replacement Participant must satisfy any applicable eligibility or participation requirements for the Retreat.

No transfer will be permitted once the five-day period immediately preceding the Retreat Start Date has begun.

8. How to Cancel

All cancellation requests must be submitted in writing by email to info[at]mapamboliretreats.com.

The date on which Ma Pamboli receives the written cancellation will be treated as the cancellation date.

Where a refund is due, it will normally be processed within 14 business days after confirmation of the cancellation and refund entitlement.

9. Cancellation or Changes by Ma Pamboli

Ma Pamboli reserves the right to make reasonable changes to a Retreat where necessary, including changes to the programme, activities, facilitators or timetable.

In the unlikely event that Ma Pamboli cancels a Retreat and does not provide the Retreat as booked, Participants will normally be offered the choice of:

  • transferring the amount paid to another available Ma Pamboli Retreat; or
  • receiving a refund of the amounts paid to Ma Pamboli for the cancelled Retreat.

Ma Pamboli will not be responsible for additional costs incurred by Participants in connection with the cancelled Retreat, such as independently booked flights, transport, accommodation or other arrangements, except where such liability cannot lawfully be excluded.

This section should be read together with the provisions relating to circumstances beyond Ma Pamboli’s reasonable control below.

10. Non-Retreat Events

Payment

Full payment may be required at the time of booking for a Non-Retreat Event unless otherwise stated.

The applicable price, payment deadline and any specific booking conditions will be communicated when registration opens or at the time of booking.

Cancellation and Refunds

Cancellation and refund arrangements may vary depending on the Non-Retreat Event and will be communicated at the time of booking.

Unless otherwise specified:

  • fees are non-refundable, subject to applicable law;
  • transfers to another person may be permitted at Ma Pamboli’s discretion; and
  • no refund will normally be provided for non-attendance.

Cancellation by Ma Pamboli

If Ma Pamboli cancels a Non-Retreat Event, Participants will be offered an appropriate refund or, where agreed with the Participant, a credit or transfer to another Event.

11. Circumstances Beyond Our Reasonable Control

Ma Pamboli will not be responsible for a failure or delay in performing its obligations where this is caused by circumstances beyond its reasonable control.

Such circumstances may include, without limitation, natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, industrial action, epidemics or pandemics, government restrictions, public-health emergencies, travel restrictions or other events that could not reasonably have been prevented or avoided by Ma Pamboli.

Where such circumstances materially affect a Retreat, Ma Pamboli will endeavour to notify Participants as soon as reasonably practicable and may reschedule, relocate, modify or, where necessary, cancel the Retreat.

Where a Retreat cannot proceed because of circumstances beyond Ma Pamboli’s reasonable control, Ma Pamboli will communicate the options available to affected Participants, taking into account any unrecoverable costs already incurred and Participants’ rights under applicable law.

12. Health and Illness

Participants are responsible for considering whether they are sufficiently well to travel to and participate in an Event.

If a Participant is unable to attend because of illness, including COVID-19 or another infectious illness, the Participant Cancellation and Refund provisions will apply.

Participants should ensure that their travel insurance provides appropriate cancellation and medical cover for their individual circumstances.

13. Third-Party Providers

Certain elements of an Event may be provided by independent third parties, including, for example, accommodation providers, transport providers, chefs and caterers, restaurants, activity and excursion providers, boat operators, wellbeing practitioners and other service providers.

Participants may be required to comply with reasonable terms, rules, safety instructions or participation requirements imposed by these providers.

Ma Pamboli will exercise reasonable care when selecting and arranging third-party services. However, where a Participant independently purchases or arranges a service directly with a third-party provider, that arrangement is between the Participant and the provider and is not part of the Participant’s contract with Ma Pamboli.

Nothing in this section excludes or limits any liability that Ma Pamboli cannot lawfully exclude or limit.

14. Changes to the Event Programme

Ma Pamboli may make reasonable changes to the programme, schedule, activities, excursions, facilitators, speakers, menus, transport arrangements or other elements of an Event where necessary for operational, safety, weather, availability or other reasonable reasons.

Where reasonably possible, Ma Pamboli will endeavour to provide a suitable alternative where a significant advertised activity or element of the Event becomes unavailable.

Minor or reasonable changes that do not materially alter the overall nature of the Event will not be treated as a cancellation of the Event.

15. Participant Conduct and Use of Property

Behaviour

Participants are expected to behave respectfully and responsibly throughout an Event.

Behaviour that is threatening, abusive, discriminatory, seriously disruptive, unsafe or otherwise adversely affects other Participants, Ma Pamboli representatives, service providers or the venue may result in the Participant being required to leave the Event.

Where removal results from a serious breach of these Terms, no refund will normally be provided.

Respect for Others

Participants must respect the privacy, wellbeing and personal boundaries of other Participants, Ma Pamboli staff, facilitators and service providers.

Harassment, discrimination, bullying, threatening behaviour or other inappropriate conduct will not be tolerated.

Use of Facilities, Equipment and Property

Participants must use venue facilities, equipment, furniture and Event materials responsibly and with reasonable care.

This includes bedrooms, communal areas, outdoor spaces, swimming pools, hot tubs, fitness equipment and any other facilities made available during an Event.

Participants may be held responsible for the reasonable cost of repairing or replacing property damaged as a result of their deliberate actions, negligence or misuse.

Safety

Participants must comply with reasonable health and safety instructions provided by Ma Pamboli, venue staff, activity providers or other authorised persons.

Prohibited Activities

Unless expressly permitted by the venue or Ma Pamboli, Participants must not:

  • smoke in indoor or non-designated areas;
  • access restricted areas or use equipment without authorisation;
  • bring unauthorised guests or non-participants into the Event venue;
  • create excessive noise or disturbance, including during designated quiet hours; or
  • possess or use illegal substances.

Failure to Comply

Ma Pamboli reserves the right to require a Participant to leave an Event where there has been a serious or repeated breach of these requirements.

Ma Pamboli may also seek reimbursement for reasonable costs arising from damage caused by the Participant.

16. Lost Property

Any items left behind at the Event venue can be returned to you by post, provided their value does not exceed £100.

The Participant is responsible for postage, packaging and any associated delivery costs, which must be paid before the item is dispatched.

Alternatively, collection may be arranged where practicable.

Requests for collection or postage must be made within one month of the Participant’s departure date. After that period, unclaimed items may be disposed of, donated or otherwise dealt with at Ma Pamboli’s reasonable discretion.

Ma Pamboli cannot guarantee that lost items will be located or recovered.

17. Valuables

Participants are solely responsible for the safety and security of any money, jewellery, electronic devices, or other valuables brought to the Event. The organiser cannot accept responsibility for the loss, theft, or damage of personal belongings at any time.

If you choose to bring valuable items, you must ensure that they are covered by your own insurance policy for the full duration of your stay.

To the fullest extent permitted by law, the organiser shall not be liable under any circumstances for any loss, damage, injury, or consequential loss suffered by participants, regardless of the cause.

18. Photo/Video Release

Please be aware that filming and photography will take place during the Event for promotional purposes. By attending the Event, you grant permission for photographs and videos taken during the event to be used for marketing and promotional content.


If you do not wish to appear in identifiable promotional photographs or video footage, please inform Ma Pamboli before the Event or as soon as reasonably practicable during the Event.

19. Intellectual Property Rights

Unless otherwise stated, materials supplied by the organiser during an Event, including workbooks, written materials, presentations, exercises, recordings and other resources, are owned by or licensed to Ma Pamboli and are protected by applicable intellectual property laws.

Materials supplied for a Participant’s personal use must not be copied, reproduced, published, distributed, sold or used for commercial purposes without prior written permission from Ma Pamboli or the relevant rights holder.

20. Participant Acknowledgement and Waiver of Liability

By booking and/or participating in a Ma Pamboli Retreat or Event, Participants acknowledge and agree that:

Nature of the Retreat

Ma Pamboli Events may include workshops, group sessions, discussions, faith-based activities, wellbeing activities and other opportunities intended to support personal reflection, spiritual growth, rest and wellbeing.

Any information, guidance, workshops, sessions or activities provided during a Retreat or Event are educational, spiritual or wellbeing-focused in nature and are not intended to constitute, or be a substitute for, professional medical, psychological, psychiatric, therapeutic, legal or financial advice, diagnosis or treatment.

The organiser does not guarantee any particular personal, spiritual, emotional, physical or other outcome as a result of attending a Retreat or Event.

Participation in Activities

Events may include optional or organised activities such as exercise or fitness sessions, swimming, sea or open-water swimming, use of swimming pools or hot tubs, hiking, walking, boat or yacht trips, snorkelling, jet skiing and other water sports, excursions, sightseeing, and visits to local markets, restaurants, food stalls or other local establishments, as well as other indoor, outdoor, recreational or cultural activities.

Participants acknowledge that such activities may involve inherent risks. Each Participant is responsible for deciding whether an activity is suitable for them, taking into account their health, fitness, abilities, experience and personal circumstances.

Participants acknowledge that some activities may involve inherent risks, particularly water-based, sporting, outdoor and excursion activities.

Each Participant is responsible for deciding whether an activity is suitable for them, taking into account their health, fitness, swimming ability, experience, personal circumstances and any guidance or safety requirements provided by Ma Pamboli or a third-party activity provider.

Participation in activities is voluntary. Participants must follow all reasonable safety instructions and use any required safety equipment. Participants should not take part in an activity if they reasonably believe that doing so would place their health, safety or wellbeing at risk.

Where activities, excursions, transport, food or other services are provided by independent third-party providers, Participants must also comply with any reasonable terms, safety requirements or instructions imposed by those providers.

Participants with food allergies, intolerances or other dietary requirements should exercise appropriate care when consuming food or drinks from restaurants, markets, street-food stalls or other third-party food providers, as Ma Pamboli cannot guarantee the ingredients, preparation methods or absence of allergens in food prepared by independent providers.

Where appropriate, Participants should seek advice from a suitably qualified healthcare professional before attending or participating in an activity.

Health, Medical Conditions and Dietary Requirements

Participants are responsible for informing the organiser within any timeframe specified before the Event, of relevant:

  • medical conditions;
  • disabilities or accessibility requirements;
  • allergies;
  • food intolerances; and
  • dietary requirements

that Ma Pamboli reasonably needs to know in order to support their participation.

Participants remain responsible for bringing and managing any medication, medical equipment or other personal health requirements they may need during the Retreat or Event.

Where a Participant has concerns about their ability to participate safely, they should seek advice from an appropriately qualified healthcare professional before attending or taking part in the relevant activity.

Ma Pamboli will endeavour to accommodate dietary requirements and allergies that have been communicated within the requested timeframe. However, Ma Pamboli cannot guarantee a completely allergen-free environment, particularly where food is prepared by third-party caterers, restaurants, markets, street-food stalls or other independent food providers.

Participants with severe or potentially life-threatening allergies are responsible for taking appropriate precautions, carrying any medication prescribed to them and informing Ma Pamboli of their requirements before the Event.

Where food is purchased or consumed independently by a Participant from a third-party provider, the Participant is responsible for making appropriate enquiries regarding ingredients and allergens directly with that provider.

Liability

To the fullest extent permitted by law, Ma Pamboli will not be responsible for loss, damage, injury or illness resulting from risks inherent in an activity, a Participant’s failure to follow reasonable instructions, or circumstances outside Ma Pamboli’s reasonable control.

Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by Ma Pamboli’s negligence.

21. Acceptance of These Terms

Payment of a Retreat Deposit, payment for a Non-Retreat Event, or other confirmation of a Booking constitutes acceptance of the Terms and Conditions applicable to that Booking.

Participants are responsible for reading these Terms and Conditions before making a payment or confirming a Booking.

22. Complaints

Ma Pamboli aims to provide Participants with a high-quality experience. If a Participant has a concern or complaint during an Event, they should raise it with a Ma Pamboli representative as soon as reasonably possible so that Ma Pamboli has an opportunity to investigate and, where possible, resolve the matter during the Event.

If the matter cannot be resolved during the Event, or the Participant wishes to make a complaint afterwards, the complaint should be submitted in writing to complaints[at]mapamboliretreats.com with sufficient information for Ma Pamboli to investigate the matter.

Ma Pamboli will acknowledge and respond to complaints within a reasonable timeframe.

24. Changes to Terms

Ma Pamboli may update these Terms and Conditions from time to time.

Any changes will be identified by updating the “Last Updated” date at the beginning of these Terms.

The Terms and Conditions applicable to a Booking will normally be those provided or made available to the Participant at the time the Booking is made, except where a change is required by law or is otherwise expressly agreed with the Participant.

Changes relating solely to use of the website will take effect from the date the updated Terms and Conditions are published.

25. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising in connection with these Terms and Conditions, subject to any mandatory rights a Participant may have under applicable consumer law, including any right to bring proceedings in the courts of the part of the United Kingdom or other jurisdiction in which they reside where applicable.

Nothing in these Terms and Conditions affects any statutory or other consumer rights that cannot lawfully be excluded or limited.
